Hello and welcome to LUNCH MUNCH®. Here you’ll find our terms and conditions. These, (“the Conditions”) apply whenever you use our online ordering service and access the www.lunchmunchkids.com website (“the Website”) as a consumer.

We kindly ask you to read these Conditions thoroughly before continuing with your order. Please note that all transactions on the lunchmunchkids.com website are subject to Polish law and that every order made by a customer (i.e. you) involves the explicit acceptance of all the Conditions as described below.

If you do not wish to accept these Conditions, we must ask that you do not continue with your order. Should you have any questions about our Terms & Conditions we’d be happy to assist you. Please send an email to hello@lunchmunchkids.com and we will respond to you ASAP.

  1. General Information

1.1. We are LUNCH MUNCH®. We believe every munch time should be fun, healthy and delicious. We make inspirational lunch accessories for children that are practical and useful. Our website is committed to providing you with a smooth experience with excellent customer service.

1.2. We are proud to be part of PRACTICAL MATTERS SP Z O.O., and our registered office is located at  Krzewo 3A, 18-421 Piatnica, Poland, registered by Krajowy Rejestr Sadowy in Poland, KRS Number: 0000734806, NIP Number: 718-214-87-74.

  1. Essential Information

2.1. By using our website and by placing orders through it, you agree to the following terms:

(a) You will only use the website to make legitimate enquiries or orders.

(b) You will not place any false or fraudulent orders. If we are reasonably of the opinion that any such order has been placed, we shall be authorised to cancel it and inform the relevant authorities.

(c) You will provide us with correct and accurate e-mail, postal address and/or other contact details, and acknowledge that we may use these details to contact you in the event of it proving necessary (please refer to our PRIVACY POLICY).

(d) You acknowledge that if you do not provide us with the information we require, it may not be possible for us to complete your order.

(e) By placing an order through the website, you declare that you are at least 18 years old and are legally capable of entering into such binding contracts.

Purchasing Process

2.2. In order to make a purchase with LUNCH MUNCH, simply follow the steps below:

(a) Browse our shop pages on our website.

(b) Simply click on the product image to access the individual product page where you will be able to see a product description along with information about colour options, where relevant.

(c) To place an item into your basket, simply select the ADD TO BASKET button near the desired product.

(d) When you have finished adding your chosen items to your basket, click on the MY BASKET link which is located in the top-right hand side of every page. If you need to preview your items you can see them there.

(e) To proceed with your purchase, click the VIEW BASKET button, which will take you through to the SHOPPING CART page.

(f) You will be able to review the items in your basket. To confirm and process your order, click the GO TO CHECKOUT button on this page and follow the instructions to finalise your purchase.

(g) If you wish to resume shopping after viewing the items in your Basket, click on any of the navigation options to return to the shopping pages.

2.3. To process your order you will be requested to provide personal details including your name, contact phone number, e-mail address, billing address, delivery address and other requested information where indicated. Please refer to our PRIVACY POLICY for further information concerning the way in which we manage your personal data.

  1. Orders and Acceptance

3.1. When you have selected the CONFIRM ORDER button and have placed an order with us we will send an email to the email address you provided during the checkout process. Please check your junk folder if you don’t see this straight away. This email will contain essential information that acknowledges and verifies your exact order details. All orders are subject to acceptance and availability, so kindly note that the acknowledgement email is neither a confirmation nor acceptance of your order and does not conclude the contract to purchase products from us. We reserve the right to reject any offer to purchase products made by you at any time.

3.2. Order acceptance and the conclusion of the contract between you and us will only take place when you have received an order dispatch email from us, unless the order has been cancelled in accordance with these Conditions.

3.3. Should further security checks require additional processing time we reserve the right to withhold any order from dispatch so that we can process all checks appropriately. Please note that this can delay an order for up to 48 hours. Also, we would ask you to be aware that all first orders must be shipped to the registered address of the cardholder that is provided when you pay for your product(s).

  1. Pre-Order Items

4.1. Sometimes we may give you the opportunity to make an advance payment for specific pre-order products while we wait for stock, so that you can make an advance purchase. This is to ensure that your order is prioritized once stock has been delivered to us. Your rights in respect of advance purchases are exactly the same as those for any other purchase on our website.

4.2. Please note that as such, when we receive products into stock, a proportion may be pre-allocated to satisfy advance payment pre-orders. Customers making advance payments will receive products in priority to customers on the waiting list or customers ordering through our website for immediate delivery. In certain circumstances we may be unable to deliver selected advance payment products due to supplier problems or quality check issues identified on receipt of stock. In such scenarios, we will notify you by e-mail and will refund the advance payment to your payment card within 30 days of being advised that the product has become unavailable.

  1. Pricing

5.1. All prices shown on the website are inclusive of VAT. We reserve the right to change our prices. Please be aware that any of our offers may be withdrawn at any time.

5.2. Please note that we are not legally bound to honour any prices where the prices displayed have been displayed incorrectly. If a product’s correct price is higher than our stated price, we will, at our discretion, either contact you before dispatch and ask whether you wish to continue with the purchase at the correct price or we may cancel your order, refund you and notify you of such a cancellation and refund.

5.3. Listed prices for products do not include the shipping or handling charges. Shipping charges are dependent on the country you are ordering to and are clearly indicated during the ordering process.  To get an estimate for shipping costs, simply add your desired items to your cart, the shipping cost choices will be displayed under the section entitled DELIVERY COST, after entering your country and zip code.

5.4. Please note that the products you purchase may be subject to taxes and to custom fees in the country of delivery. These supplementary costs are your responsibility as the customer.

5.5. For courier shipments with GLS, you as a customer will be responsible for the order’s online tracking (the tracking number is included in the order confirmation mail).

5.6. Discount codes provided by LUNCH MUNCH® are valid only if they can be applied in the purchase before payment.

  1. Terms of Payment

Online payments are possible via a number of debit/credit cards. We currently accept the following payment methods: Visa, MasterCard, Maestro, PayU and PayPal. Our acceptance of payment is conditional on subsequent validation of the card transaction with the issuer. You must confirm that the credit/debit card being used for the purchase, belongs to you. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. Such checks may include credit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction) and be carried out to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. As such we may share your personal data with third parties as are necessary to enable us to do perform these checks.

  1. Insurance

All our products are insured by us during the time that they are in transit from our premises to your delivery address. Upon the delivery of your order, you will be asked to sign for any products. At this point the responsibility for the purchased products passes over to you.

  1. Product Warranties and Availability

8.1. We have taken all steps to present products on our website as accurately as possible. However, we accept no responsibility for inconsistencies in colour or style due to the settings on your computer monitor or mobile device. We ask you to be aware that there may be some minor differences between the specifications given for products on the website and the product that you receive, as the products we sell are not mass produced.

8.2. Whilst we take every effort to ensure all products offered on our website are always in stock, occasionally some products will be temporarily unavailable and cannot be restocked. We will always attempt to contact you via an email to the delivery address that you gave us when placing your order, should any products in your order be out of stock or subject to a delay.

8.3. All products advertised on our website are for the personal use of consumers only. You must not resell or apply any trade marks to any product that you purchase from the website and they must not be used for any form of advertising or promotional purpose. We reserve the right to restrict multiple quantities of a product being shipped to a single address or customer.

  1. Delivery

9.1. All postage and packaging charges are displayed when you place an order or as shown in a SHOPPING CART. Please be aware that we do not deliver on Sundays, Bank Holidays, Christmas Day, Boxing Day and New Years Day.

9.2. We aim to dispatch all orders within 24 hours. However, please allow up to 7 working days for delivery as external factors may cause delays. Your order is able to be shipped once the following criteria has been fulfilled: (a) your payment has been approved; and (b) your delivery/billing address has been verified. Orders placed after 2.00 PM will not be dispatched until, the following day, at the earliest.

9.3. Delivery costs are as stated on ALL orders placed. Returns are charged at cost to the customer unless the product is faulty. Products will be delivered via our carrier partners: Polish Post and GLS.

  1. Cancellation, Refunds and Return Policy

10.1. Should there be a fault with your products, please contact us within 28 days of purchase via email (hello@lunchmunchkids.com), confirming your order number so we can provide you with a replacement (if available) or a full refund. Please note that we will absorb and refund the costs of returning faulty items to us via the Polish Post Second Class service.

10.2. Under the Polish Consumer (Distance Selling) Regulations from March 2000, any online orders placed through lunchmunchkids.com can be canceled in order to have a full refund. To cancel your order, email us or call us within 30 days after receipt of purchase and quote your order reference number. The items must be returned unused, and where ever possible, in the original packaging.

10.3. We regret that delivery charges to return any unwanted items are non-refundable. Should you change your mind about the product(s) you have ordered you will be responsible for the cost of returning those products to us.

  1. Returns Policy

11.1. When returning products to us, we ask you to follow the process and steps as set out below:

(a) In the first instance, please contact to obtain a returns number and a returns address; and

(b) return your product in the original packaging, with a note including details of your name, returns number, contact details, order reference number and the reason why you either: (i) wish to return your product or cancel your order; or (ii) the reason why you believe your product is faulty.

This assists us in processing your possible replacement or refund. Products must be returned unused and, where possible, in the original packaging. Please therefore keep the original packaging until you are certain you wish to keep your product.

11.2. Return costs will only be refunded if the product is faulty, or if it differs from the advertised product. We are unable to accept responsibility for any parcels returned to us until we safely receive them. Where the delivery of an order is refused, we reserve the right to deduct from the refund both the original delivery cost plus the cost of returning the goods to us.

  1. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these Conditions if such a delay or failure arises from a cause that is beyond our reasonable control. Examples of such delays or failures may include failure by our delivery companies to deliver your products on time due to exceptional circumstances such as hazardous weather conditions, accidents or strike action.

  1. Refusal of order

14.1. Please note that we reserve the right to withdraw any products from our website at any time and/or remove or edit any materials or content on this website. Whilst we will always make our best efforts to always process all orders, there may be exceptional circumstances that mean we may need to refuse to process an order after we have sent you an Order Confirmation. We reserve the right to do this at any time, at our sole discretion.

14.2. We will not be liable to you or any other third party by withdrawing any product from the website, whether it has been sold or not, removing or editing any materials or contents on the website or for refusing to process or accept an order after we have sent you the Order Confirmation.

15.1. We are the owners of all intellectual property rights in our website, and in the material published on it including the “LUNCH MUNCH®” trade mark. These works are protected by copyright and international trademark laws and treaties around the world. All such rights are reserved.

15.2. The reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless expressly authorized by PRACTICAL MATTERS SP. Z O.O.
